The company Edrinks Cy based in Nicosia (hereafter referred to as the Organizer for brevity’s sake), organizes the Instagram competition Weekend Green Monday Day at Coral Beach Hotel & Resort

Weekend Green Monday Giveaway in the context of promoting the Organizer’s products.

By participating in the competition, all participants fully and without reservation accept the following terms:

Eligibility – Conditions

Those who have reached the age of 18, are permanent residents of the free area of Cyprus and have the legal capacity to participate in the competition have the right to participate in the competition. The employees of Edrinks cy, Savero Distributors Ltd, Coral Beach Hotel & Resort and their partners as well as their spouses and first and second degree relatives are not eligible to participate.

In the event that a person who is not entitled to participate participates in the Competition and is the lucky winner of the prize, his participation will be cancelled, he will be deprived of the relevant right and he will not be granted the corresponding prize.

Duration

2.1 The competition starts on Thursday 16th February 2023 (hereinafter the “Competition Commencement”) and ends on Friday 24 February 2023 (hereinafter the “Competition End”).

Friday 24 February 2023 is set as the draw date.

2.2 Entries submitted within the time limits of the competition are considered valid and after the expiration date of the above competition, no participation will be accepted.

2.3. The Organizing Company reserves the right to modify, limit or extend the duration of the competition, by amending these terms.

Participation in the contest

The way to participate in the competition is:

Participants must follow the @eDrinks Cy account on Instagram and comment on the contest-related post by tagging an adult friend. All entries will be collected and on the specified date mentioned above a prize draw will take place.

4.1. The Prizes that will be drawn are 1 Night Complimentary accommodation for 2 persons which includes the following:

• Accommodation in a sea view room on a bed & breakfast basis
• Including Green Monday Lunch on February the 27th 2023

Entrants will win the prizes following a draw held at the Edrinkcy offices, which will include all entries collected by the date of the draw.

4.2. The Prize is personal and the winners of the Competitions do not have the right to exchange it for money or other substitutes.

Method of selecting the winner of the Competition

From this application, 1 lucky person will be randomly selected, who will win one night at the Coral Beach Hotel & Resort for 2 people and two (2) runners-up. In the event that it is not possible to contact any winner within one day and they (including lucky winners and force majeure) do not contact the Promoter within the above time period, or in the event that at any point in time it is deemed that an entry is not was valid, this person permanently loses his right to the Contest Prize. Afterwards, the prize is awarded to the runners-up, in order of their selection from the lottery. The runners-up will be contacted the same day after the final loss of the right to obtain the gift from the winners. If none of the runners-up can be found or it is judged that their participation was not valid, etc., the Organizer has the right to cancel the gift or allocate it at its absolute discretion to the next runner-up in order.

As “valid participation” as above, means any participation in the Competition for which the following applies cumulatively:

(a) has been formed in accordance with the present conditions posted on the Website and does not contravene the applicable legislation, good morals and public order,

(b) has been submitted in accordance with the procedure described in Article 3;

(c) in the judgment of the Organizer, the participation is not in itself the product of illegal technical influence on the Organizer’s systems or in general fraud or unfair interference by the participant or a third party and

(d) has been submitted and registered in the Organizer’s systems, within the specified time period.

Receiving a gift

The winner, after informing that they accept the Gift, will receive a personal message, in which they will be asked for their information for identification. The receipt of the Gift will be done after consultation with the company.

Privacy

The collection and processing of the personal data of the participants is done in accordance with the provisions of the national legislation and the General Regulation on the Protection of Personal Data (EU 679/2016). Modification of Terms

The Organizer reserves the right to change these conditions, to shorten or extend the duration of the competition or to revoke it with prior notice by any suitable means.

Acceptance of Terms – Consent

9.1 Participation in the competition presupposes and implies the unconditional acceptance of all the terms herein.

9.2 Participation in the competition may be subject to changes or interruptions that are completely dependent on the capabilities of the existing technology on which the energy is based and which are beyond the control and responsibility of the Organizer, who bears no responsibility for all the above reasons .

Cancellation of participation in the competition

Any of the winners at any stage may be disqualified for the following reasons:

(a) in the event that, for any reason, you do not fully accept these terms in their entirety, all of which shall be deemed to be material;

(b) in the event that his participation does not meet any of the conditions herein,

(c) in the event that, for any reason, the attempt to contact the winner to claim the prize is unsuccessful.

(d) in the event that at any stage of the Competition, including that of receiving the Gifts, any winner does not wish to accept their Gift or refuses to sign a certificate of acceptance thereof or refuses to provide proof of their identity, such as public documents (e.g. identity card, passport, driver’s license), or does not, for any reason, fully accept these Terms in their entirety, all of which are considered essential, that person’s participation is canceled and that person permanently loses their right to the Gift.

(e) the Organizer reserves the right to cancel entries, with the result that those interested do not participate in the competition, in the event that their information is incomplete, offends the image of the organizer or good manners and customs, public opinion, etc.

In any case of cancellation of the participation of a winner, his right to the prize is acquired by the next runner-up.

Organizer responsibility

The Organizer is not responsible in the event that for any technical reason it is temporarily impossible to receive and register the participation of any participant from the system for registering participations in the Competition and selecting the winner. In any case, the Organizer’s liability will be limited to its acts or omissions due to fraud or gross negligence and in no case will it extend to lucky events or force majeure events. The Organizer is not responsible for the winner and participants in the event that, due to Force Majeure, it is unable to fulfill its obligations arising from these conditions. H εταιρεία Edrinks Cy με έδρα την Λευκωσία(εφεξής καλουμένη χάριν συντομίας Διοργανώτρια), διοργανώνει το διαγωνισμό Instagram Weekend Valentine’s Day at Coral Beach Hotel & Resort

Instagram Weekend Green Monday στο πλαίσιο προώθησης των προϊόντων της Διοργανώτριας.

Με τη συμμετοχή στο διαγωνισμό, όλοι οι συμμετέχοντες αποδέχονται πλήρως και χωρίς καμία επιφύλαξη τους ακόλουθους όρους:

Δικαίωμα Συμμετοχής – Προϋποθέσεις

Δικαίωμα συμμετοχής στο διαγωνισμό έχουν όσοιέχουν συμπληρώσει το 18ο έτος της ηλικίας τους, είναι μόνιμοι κάτοικοι ελεύθερης περιοχής Κύπρου  και έχουν δικαιοπρακτική ικανότητα. Δεν έχουν δικαίωμα συμμετοχής, οι εργαζόμενοι των εταιρειών Edrinks cy, Savero Distributors Ltd, Coral Beach Hotel & Resort και οι συνεργάτες τους καθώς και οι σύζυγοι και οι συγγενείς τους α’ και β’ βαθμού.

Σε περίπτωση κατά την οποία συμμετάσχει στον Διαγωνισμό πρόσωπο το οποίο δε δικαιούται να συμμετάσχει και είναι ο τυχερός του δώρου, η συμμετοχή του θα ακυρώνεται, θα εκπίπτει του σχετικού δικαιώματος και δεν θα του χορηγείται το αντίστοιχο δώρο.

Διάρκεια

2.1 Ο διαγωνισμός ξεκινά τη Πέμπτη 16^η Φεβρουαρίου 2023 (περαιτέρω η «Έναρξη του Διαγωνισμού») και λήγει την Παρασκευή 24 Φεβρουαρίου 2023 (περαιτέρω η «Λήξη του Διαγωνισμού»).

Η Παρασκευή 24 Φεβρουαρίου 2023 ορίζεται ως ημερομηνία διεξαγωγής της κλήρωσης.

2.2 Έγκυρες θεωρούνται οι συμμετοχές που υποβάλλονται εντός των χρονικών ορίων του διαγωνισμού και μετά την πάροδο της ημερομηνίας λήξης του ως άνω διαγωνισμού, καμία συμμετοχή δε θα γίνεται δεκτή.

2.3. Η Διοργανώτρια Εταιρεία διατηρεί το δικαίωμα να τροποποιήσει, να περιορίσει ή παρατείνει τη διάρκεια διεξαγωγής του διαγωνισμού, με τροποποίηση των παρόντων όρων.

Οι συμμετέχοντες θα πρέπει να κάνουν follow τον λογαριασμό @eDrinks Cy και Coral Beach Resort στο Instagram like στο post και να σχολιάσουν τη σχετική με το διαγωνισμό δημοσίευση κάνοντας tag 2 ενήλικο/ ενήλικη φίλο/φίλη τους. Όλες οι συμμετοχές θα συγκεντρωθούν και στην ορισμένη ημερομηνία που αναφέρεται παραπάνω θα πραγματοποιηθεί κλήρωση για τα δώρα.

Οι συμμετέχοντες θα κερδίσουν τα δώρα κατόπιν κλήρωσεων που θα πραγματοποιηθούν στα γραφεία της Edrinkcy , στην οποία θα συμμετέχουν όλες οι καταχωρήσεις που θα έχουν συλλεχθεί έως την ημερομηνία διεξαγωγής της κλήρωσης.

4.2. Tο Δώρο είναι προσωπικό και οι νικητές των Διαγωνισμών δεν έχουν το δικαίωμα ανταλλαγής του με χρήματα ή άλλα αντικαταστατά πράγματα.

Τρόπος ανάδειξης του νικητή του Διαγωνισμού

Από συγκεκριμένη εφαρμογή θα επιλεχθούν τυχαία 1 τυχερός, που θα κερδίσει μία βραδιά στον ξενοδοχείο Coral Beach Hotel & Resort για 2 άτομα και δύο (2) επιλαχόντες. Σε περίπτωση που δεν καταστεί δυνατή η επικοινωνία με οποιοδήποτε νικητή εντός μίας ημέρας  και δεν επικοινωνήσει εκείνος (συμπεριλαμβανομένων και των τυχερών και της ανωτέρας βίας) με το Διοργανωτή εντός του ανωτέρω χρονικού διαστήματος, ή σε περίπτωση που σε οποιοδήποτε χρονικό σημείο κριθεί ότι κάποια συμμετοχή δεν ήταν έγκυρη, το πρόσωπο αυτό χάνει οριστικά το δικαίωμά του επί του Δώρου του Διαγωνισμού. Εν συνεχεία, το δώρο παραχωρείται στους επιλαχόντες, κατά σειρά ανάδειξής τους από την κλήρωση. Η επικοινωνία με τους Επιλαχόντες γίνεται την ίδια μέρα μετά την οριστική απώλεια δικαιώματος απόκτησης του δώρου από τους αναδειχθέντες νικητές. Αν ούτε κάποιος από τους επιλαχόντες μπορεί να βρεθεί ή κριθεί ότι η συμμετοχή του δεν ήταν έγκυρη κτλ., ο Διοργανωτής έχει το δικαίωμα να ακυρώσει το δώρο ή να το διαθέσει κατά την απόλυτη κρίση του σε επόμενο κατά σειρά επιλαχόντα κοκ.

Ως «έγκυρη συμμετοχή» κατά τα ανωτέρω, νοείται οποιαδήποτε συμμετοχή στον Διαγωνισμό για την οποία ισχύουν αθροιστικά τα κατωτέρω:

(α) έχει διαμορφωθεί σύμφωνα με τους παρόντες όρους που έχουν αναρτηθεί στον Ιστότοπο και δεν αντιβαίνει στην εκάστοτε ισχύουσα νομοθεσία, στα χρηστά ήθη και στη δημόσια τάξη,

(β) έχει υποβληθεί σύμφωνα με τη διαδικασία που περιγράφεται στο άρθρο 3,

(γ) δεν αποτελεί, κατά την κρίση του Διοργανωτή, αυτή καθ’ εαυτή η συμμετοχή προϊόν παράνομης τεχνικής επιρροής στα συστήματα του Διοργανωτή ή εν γένει απάτης ή αθέμιτης παρεμβολής του συμμετέχοντα ή τρίτου και

(δ) έχει υποβληθεί και έχει καταχωρηθεί στα συστήματα του Διοργανωτή, εντός του ορισμένου χρονικού διαστήματος.

Παραλαβή δώρου

Ο νικητής αφού ενημερώσει ότι αποδέχονται το Δώρο, θα λάβει ένα προσωπικό μήνυμα, στο οποίο θα του ζητούνται τα στοιχεία του για την ταυτοποίηση. Η παραλαβή του Δώρου θα γίνει κατόπιν συνεννόησης με την εταιρεία.

Προσωπικά δεδομένα

H συλλογή και επεξεργασία των προσωπικών του δεδομένων των συμμετεχόντων γίνεται σύμφωνα με τις διατάξεις της εθνικής Νομοθεσίας και του Γενικού Κανονισμού περί Προστασίας Προσωπικών Δεδομένων (ΕΕ 679/2016). Ο κάθε συμμετέχων έχει δικαίωμα πρόσβασης, διαγραφής, περιορισμού της επεξεργασίας με βάση τις σχετικές διατάξεις του Κανονισμού, αποστέλλοντας το σχετικό αίτημα στο [email protected]. Η πολιτική απορρήτου και οι όροι χρήσης που ορίζει ο Γενικός Κανονισμός Προστασίας Προσωπικών Δεδομένων (2016/679) βρίσκονται εδώ.

Τροποποίηση Όρων

Η Διοργανώτρια επιφυλάσσεται του δικαιώματός της να μεταβάλλει τους παρόντες όρους, να συντομεύσει ή να παρατείνει τη διάρκεια του διαγωνισμού ή να τον ανακαλέσει με προηγούμενη ανακοίνωσή της με κάθε πρόσφορο προς τούτο μέσο.

Αποδοχή των όρων – Συναίνεση

9.1 Η συμμετοχή στο διαγωνισμό προϋποθέτει και συνεπάγεται την ανεπιφύλακτη αποδοχή όλων των όρων του παρόντος.

9.2 Η συμμετοχή στο διαγωνισμό μπορεί να τύχει μεταβολών ή διακοπών που εξαρτώνται πλήρως από τις δυνατότητες της υπάρχουσας τεχνολογίας πάνω στην οποία στηρίζεται η ενέργεια και οι οποίες είναι πέρα από τον έλεγχο και την ευθύνη της Διοργανώτριας η οποία δεν υπέχει καμία ευθύνη για όλους τους ανωτέρω λόγους.

Ακύρωση συμμετοχής στο διαγωνισμό

Οποιοσδήποτε από τους νικητές σε οποιοδήποτε στάδιο μπορεί να ακυρωθεί για τους εξής λόγους:

(α) σε περίπτωση που, για οποιονδήποτε λόγο, δεν αποδεχθεί πλήρως τους παρόντες όρους στο σύνολό τους, οι οποίοι θεωρούνται όλοι ουσιώδεις,

(β) σε περίπτωση που η συμμετοχή του δεν πληροί κάποιον από τους όρους του παρόντος,

(γ) σε περίπτωση που για οποιονδήποτε λόγο, η προσπάθεια επικοινωνίας με το νικητή για την αξιοποίηση του δώρου αποβεί άκαρπη.

(δ) σε περίπτωση που σε οποιοδήποτε στάδιο του Διαγωνισμού, ακόμα και αυτό της παραλαβής των Δώρων, οποιοσδήποτε νικητής δεν επιθυμεί να αποδεχθεί το Δώρο του ή αρνηθεί να υπογράψει βεβαίωση αποδοχής αυτού ή αρνηθεί να προσκομίσει αποδεικτικά της ταυτότητάς του, όπως δημόσια έγγραφα (πχ αστυνομική ταυτότητα, διαβατήριο, δίπλωμα οδήγησης), ή δεν αποδεχτεί, για οποιονδήποτε λόγο, πλήρως του παρόντες Όρους στο σύνολό τους, οι οποίοι θεωρούνται όλοι ουσιώδεις, η συμμετοχή του προσώπου αυτού ακυρώνεται και το πρόσωπο αυτό χάνει οριστικά το δικαίωμά του επί του Δώρου.

(ε) η Διοργανώτρια διατηρεί την ευχέρεια να ακυρώσει συμμετοχές με αποτέλεσμα οι ενδιαφερόμενοι να μην συμμετέχουν στο διαγωνισμό, σε περίπτωση που τα στοιχεία τους είναι ελλιπή, προσβάλλουν την εικόνα της διοργανώτριας ή τα χρηστά ήθη και έθιμα, τη δημοσία αιδώ κλπ.

Σε κάθε περίπτωση ακύρωσης της συμμετοχής ενός νικητή, το δικαίωμά του στο δώρο το αποκτά ο αμέσως επόμενος επιλαχών.

Ευθύνη Διοργανωτή

Ο Διοργανωτής δεν ευθύνεται στην περίπτωση που για οποιονδήποτε τεχνικό λόγο είναι προσωρινώς αδύνατη η λήψη και καταχώρηση συμμετοχής οποιουδήποτε συμμετέχοντα από το σύστημα καταχώρησης συμμετοχών στον Διαγωνισμό και ανάδειξης του νικητή. Σε κάθε περίπτωση η ευθύνη του Διοργανωτή θα περιορίζεται σε πράξεις ή παραλείψεις του από δόλο ή βαρεία αμέλεια και σε καμία περίπτωση δε θα εκτείνεται σε τυχερά γεγονότα ή γεγονότα ανωτέρας βίας. Ο Διοργανωτής δεν ευθύνεται έναντι του νικητή και συμμετεχόντων σε περίπτωση που λόγω Ανωτέρας Βίας δεν είναι σε θέση να τηρήσει τις υποχρεώσεις του που απορρέουν από τους παρόντες όρους. Ο Διοργανωτής δε θα ευθύνεται για τυχόν καθυστερήσεις, αλλαγές

Ο Διαγωνισμός δεν χορηγείται, δεν υποστηρίζεται και δεν διεξάγεται από το Instagram, ούτε συνδέεται μαζί του με οποιονδήποτε τρόπο, ως εκ τούτου το Instagram δεν φέρει ουδεμία ευθύνη για οποιαδήποτε απαίτηση ή αξίωση συμμετέχοντα ή οποιουδήποτε τρίτου προκύψει από τον παρόντα Διαγωνισμό ή σε σχέση με αυτόν.
